CARHUNTR — TERMS OF SERVICE (UK)

These Terms of Service (“Terms”) govern your access to and use of the Carhuntr mobile applications and website (together, the “Services”). The Services are operated by Take Apart Solutions Limited, trading as Carhuntr (“Carhuntr”, “we”, “us”, “our”).

By downloading, registering for, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
1) DEFINITIONS
In these Terms:
• “Account” means your registered user account for accessing the Services.
• “App Store Provider” means a third-party marketplace operator through which you may download the app and/or purchase subscriptions (for example, Apple or Google).
• “Dealer Plan” means the subscription plan described in Section 6.
• “Free Tier” means limited access to the Services, including a limited number of free Notifications (Section 7).
• “Notification” means an alert delivered through the Services based on your saved criteria.
• “Plan” means a paid subscription plan (including Pro or Dealer) or any future plan we introduce.
• “Pro Plan” means the subscription plan described in Section 6.
• “Tokens” means units that permit access to certain feature unlocks (Section 8).
• “Vehicle Data” means any vehicle-related information displayed in the Services, including listing details, valuations, write-off/stolen checks, MOT- related information, profit estimates, or similar data.
• “User”, “you”, and “your” mean the person using the Services.
2) ELIGIBILITY AND WHO MAY USE THE SERVICES
2.1 Minimum age and capacity
The Services are rated 4+ on app marketplaces. However, to use the Services you must be able to enter into a legally binding contract, or you must use the Services with the involvement and permission of a parent or legal guardian who agrees to these Terms on your behalf.If you are under 18, you confirm that your parent or legal guardian has reviewed and accepted these Terms and is responsible for your use of the Services.
2.2 Business use
If you use the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.
3) UK-ONLY VERSION
This version of the Services is designed for use in the United Kingdom. Vehicle coverage, Notifications, checks, and other features may not work outside the UK. We make no representation that the Services are available or suitable outside the UK.
4) THE SERVICES AND IMPORTANT DISCLAIMERS
4.1 What Carhuntr does
Carhuntr provides tools that help users identify vehicle opportunities more efficiently, including alerts/Notifications, saved vehicles, and access to certain checks/reports via Tokens.
4.2 What Carhuntr is not
Carhuntr is not:
• a vehicle seller, broker, dealer, insurer, auction house, or finance provider;
• a valuation authority; or
• a provider of legal, financial, mechanical, or professional advice.
4.3 Vehicle Data accuracy and verification (important)
The Services may display Vehicle Data sourced from third parties (including listings, valuations, write-off and stolen checks, MOT-related data, and similar information). Vehicle Data may be incomplete, delayed, inaccurate, or unavailable.
You are solely responsible for:
• verifying vehicle condition, history, mileage, ownership, title, finance, theft status, and legal compliance;
• conducting your own inspections and independent checks; and
• making your own buying/selling decisions.
Profit estimates and guidance tools: any profit estimates, deal scores, or similar features are guidance only and may be inaccurate. They do not guarantee profitability or outcomes.
4.4 Notifications and availability
We do not guarantee that:
Notifications will be delivered in real time;
you will receive every Notification;
any vehicle will remain available; or
the Services will be uninterrupted, error-free, or always available.
5) ACCOUNTS AND SECURITY
You must provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your Account and for all activity that occurs under it. You must notify us promptly if you suspect unauthorised access.
We may refuse registration, suspend, or terminate Accounts in accordance with these Terms.
6) PLANS, PRICING, BILLING, AND SUBSCRIPTIONS
6.1 Plans and pricing
Unless otherwise displayed in-app at the time of purchase, current pricing is:
Pro Plan
• £39.99 monthly
• £359.99 yearly
• includes up to 5 alerts (as displayed in-app)
Dealer Plan
• £99.99 monthly
• £659.99 yearly
• includes up to 100 alerts (as displayed in-app)
Plan features, limits, and inclusions may change over time and are shown in-app.
6.2 Recurring billing and renewal
Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. Cancelling a subscription stops further charges and access continues until the end of the current billing period.
6.3 Purchase routes and platform rules
Subscriptions may be purchased through App Store Providers and/or other payment routes where available. Where an App Store Provider’s billing, cancellation, or refund rules apply, those rules may govern your purchase and may override certain parts of our processes.
6.4 Failed payments and grace period
If a payment fails, we may provide a 14-day grace period for you to update your payment method and complete payment. If payment is not successfully completed after the grace period, we may suspend access and cancel your subscription. If payment is successfully completed during the grace period, access will be restored.
6.5 Changes to pricing or Plans
We may change pricing, Plans, features, or limits. Where required, we will provide reasonable notice via the Services and/or email. Changes typically take effect at the start of your next billing period unless stated otherwise.
7) FREE TIER (50 NOTIFICATIONS) AND ANTI-ABUSE
7.1 Free Tier
The Free Tier allows limited access to the Services, including 50 Notifications total. After you reach the Free Tier limit, you may still be able to view vehicles, but you may be required to subscribe to a Plan to continue receiving Notifications and to access additional features (such as MOT history, previous listings, valuations, and vehicle record checks, as made available in-app).
7.2 Anti-abuse and circumvention
The Free Tier is offered to allow genuine evaluation of the Services. The Free Tier limit is applied per person, per device, and per Account, and is not granted per download.
You must not attempt to circumvent Free Tier limits or other restrictions, including by:
• creating multiple Accounts;
• using temporary or disposable email addresses;
• resetting devices, identifiers, or app installations;
• using automation or scripts; or
• any other attempt to obtain additional free Notifications beyond the intended limit.
Where we reasonably believe circumvention, abuse, or manipulation has occurred, we may, in our discretion:
• deny or revoke Free Tier access;
• limit or reset Notifications;
• suspend or terminate Accounts; and/or
• restrict access to the Services.
8) TOKENS (FEATURE UNLOCKS)
8.1 What Tokens do
Tokens allow you to unlock certain features in the Services, such as:
• write-off checks;
• stolen checks; and
• valuations
(as displayed in-app).
8.2 Tokens are a limited licence, not property
Tokens are not property, have no monetary value, and do not represent money, stored value, or a payment account. Tokens are a limited, revocable permission to access certain features within the Services in accordance with these Terms and the rules displayed in-app.
Accordingly:
• Tokens are non-transferable and may not be sold, gifted, traded, or assigned.
• Tokens do not expire and carry over between billing periods unless we expressly state otherwise in-app.
• If you cancel your subscription, Tokens remaining on your Account will remain available unless and until your Account is deleted (subject to these Terms).
• We may change Token-related features, pricing, or rules where required by law and with reasonable notice where appropriate.
8.3 Account deletion and Tokens
If you delete your Account, all remaining Tokens are forfeited, lost permanently, and are non-refundable, except where required by law.
9) REFUNDS AND CANCELLATIONS
9.1 App Store Provider purchases (Apple/Google)
If you purchase through an App Store Provider, refunds are handled by that platform and are subject to their policies and discretion. We cannot approve refunds on their behalf.
9.2 Other purchases (e.g., Stripe) where available
Where purchases are processed outside an App Store Provider (where offered), refund decisions are handled by Carhuntr in accordance with applicable law. We may grant or refuse refunds at our discretion, acting reasonably and fairly, except where you have a legal right to a refund.9.3 No partial-period refunds
We do not offer refunds for partially used subscription periods, except where required by law.
10) ACCEPTABLE USE AND RESTRICTIONS
You must not:
• reverse engineer, decompile, copy, modify, or create derivative works of the Services;
• scrape, harvest, extract, or access data from the Services using automated means;
• resell, redistribute, or commercially exploit Notifications, outputs, or access to the Services;
• share Accounts (one Account per user);
• bypass usage limits, access controls, or security measures;
• interfere with the Services or attempt to disrupt performance;
• use the Services for unlawful, fraudulent, abusive, or harmful purposes; or
• use the Services to compete with or replicate Carhuntr.
We may monitor usage to detect abuse, ensure security, and enforce these Terms.
11) INTELLECTUAL PROPERTY
The Services and all associated software, designs, trademarks, and Content are owned by Carhuntr and/or its licensors and are protected by intellectual property laws.We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your personal or internal business use in accordance with these Terms.
12) COMMUNICATIONS (EMAIL, PUSH, SMS, CALLS)
We may contact you about the Services by email, in-app messages, push notifications, and SMS where permitted.
SMS opt-out: if we send you marketing SMS messages, you can opt out at any time by replying STOP. You may still receive essential service-related messages where permitted by law (for example, security or billing notices).
Call recordings: we may record calls (including customer support calls) for purposes such as quality assurance, training, compliance, fraud prevention, and dispute handling. Further details are in our Privacy Notice.
13) SUSPENSION AND TERMINATION
We may suspend or terminate your access to the Services and/or your Account at any time where we reasonably believe:
• you have breached these Terms;
• fraud, abuse, or circumvention has occurred;
• payments are overdue beyond the grace period;
• we are required to do so by law; or
• continued access presents risk to the Services, Carhuntr, or other users.
You may stop using the Services at any time. You can cancel subscriptions through the relevant platform. Termination does not automatically entitle you to a refund except where required by law.
Sections that by their nature should survive termination will survive (including IP, disclaimers, limitation of liability, and indemnity).
14) LIMITATION OF LIABILITY (IMPORTANT)
Nothing in these Terms excludes or limits liability that cannot be excluded under law, including liability for:
• death or personal injury caused by negligence; or
• fraud or fraudulent misrepresentation.
Subject to the above, and to the maximum extent permitted by law:
• we are not liable for indirect, consequential, special, or exemplary losses, including loss of profit, loss of revenue, loss of business, loss of data, missed opportunities, or reputational harm; and
• our total liability arising out of or in connection with the Services will not exceed the total fees you paid to Carhuntr for the Services in the three (3) months immediately preceding the event giving rise to the claim.
15) INDEMNITY
You agree to indemnify and hold harmless Carhuntr from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your violation of law.
16) CHANGES TO THE SERVICES OR TERMS
We may modify or discontinue any part of the Services at any time. We may also update these Terms from time to time. If changes are material, we will provide notice via the Services and/or email where required. Continued use after changes take effect constitutes acceptance.
17) GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction, subject to any mandatory consumer protection rights.
18) PRIVACY
Our Privacy Notice explains how we process personal information. By using the Services, you acknowledge that you have read and understood the Privacy Notice.
